Welcome to Art City Camp and RV Retreat. These Terms of Service (“Terms”) establish the rules and conditions governing reservations and stays at our property.
By making a reservation, completing a booking through Airbnb, Hipcamp, or another authorized booking platform, or entering and using the property, you agree to comply with these Terms, our property rules, and any applicable policies provided during the reservation process.
Please read these Terms carefully before booking.
1. Our Property
Art City Camp and RV Retreat is an outdoor hospitality property located in Tucumcari, New Mexico, offering RV accommodations, glamping accommodations, camping experiences, and related outdoor amenities.
Our property is designed to provide guests with an opportunity to enjoy nature, art, outdoor living, peace, relaxation, and memorable experiences.
Because our property is an outdoor environment, guests should expect natural conditions, including uneven ground, wildlife, insects, weather changes, dust, wind, heat, cold, and other conditions commonly associated with outdoor accommodations.
2. Reservations and Booking Platforms
Reservations may be made through authorized third-party booking platforms, including Airbnb and Hipcamp.
When booking through Airbnb or Hipcamp, guests are also subject to that platform’s terms, policies, cancellation rules, and community standards.
A reservation is considered confirmed according to the applicable booking platform’s confirmation process.
Guests are responsible for providing accurate information when making a reservation, including the correct number of guests and any information necessary to safely accommodate their party.
3. Guest Eligibility and Responsibility
The person making the reservation is responsible for:
- Providing accurate reservation information
- Ensuring that all members of their party comply with these Terms
- Providing appropriate supervision of children and minors
- Ensuring that guests and visitors follow property rules
- Paying applicable reservation charges, fees, and damages
- Reporting problems or unsafe conditions promptly
Guests may not use the property for illegal activities or activities that violate Airbnb, Hipcamp, or applicable local, state, or federal requirements.
4. Check-In and Check-Out
Guests must follow the check-in and check-out times provided with their reservation.
Early check-in or late check-out is not guaranteed and may require prior approval.
Guests who remain on the property beyond their authorized departure time without permission may be subject to additional charges where permitted by the applicable booking platform and law.
5. Occupancy and Additional Guests
Only the number of guests included in the reservation may stay overnight unless Art City Camp and RV Retreat has approved additional guests in advance.
Guests may not exceed the maximum occupancy of the accommodation.
Unregistered overnight guests may result in additional charges or termination of the reservation, subject to applicable booking-platform policies and law.
6. Visitors
Visitors who are not included in the reservation may require prior approval.
Guests are responsible for the conduct and actions of their visitors and must ensure that visitors follow all property rules.
7. Property Care
Guests are expected to treat the accommodations, RV spaces, structures, furnishings, outdoor areas, equipment, amenities, and surrounding property with reasonable care.
Guests must not:
- Damage or intentionally misuse property
- Remove furnishings, equipment, or property belonging to Art City Camp
- Tamper with utilities or electrical systems
- Alter or disconnect property equipment without permission
- Climb on structures or equipment not intended for climbing
- Enter restricted or private areas
- Interfere with property maintenance or security equipment
Guests may be responsible for reasonable costs associated with damage caused by the guest or members of their party, subject to applicable law and booking-platform policies.
8. Security Cameras
For the safety and security of guests, visitors, and property, Art City Camp and RV Retreat uses security cameras in designated outdoor/common areas.
Cameras are not intentionally placed inside guest accommodations, bathrooms, or private shower areas.
Guests may not cover, move, disconnect, damage, or otherwise interfere with security cameras or security equipment.
Security footage may be used for legitimate safety, security, property-protection, incident-investigation, or legal purposes.

9. Outdoor Showers and Amenities
Outdoor showers and other outdoor amenities are provided as part of the property’s experience.
Guests use outdoor amenities at their own discretion and are responsible for following posted instructions and safety rules.
Guests should exercise caution because outdoor surfaces may become wet, slippery, muddy, uneven, hot, or otherwise hazardous depending on weather and conditions.
Children must be appropriately supervised when using outdoor amenities.
10. Starlink Wi-Fi
Art City Camp and RV Retreat may provide internet access through Starlink.
Internet service is provided as an amenity and is not guaranteed to be uninterrupted, available at all times, or suitable for every purpose.
Service may be affected by weather, equipment, network conditions, outages, maintenance, or circumstances outside our control.
Guests agree to use the internet lawfully and responsibly.
Guests may not use the network for illegal activity, harassment, unauthorized access to systems, distribution of malicious software, copyright infringement, or other unlawful activity.
Art City Camp and RV Retreat is not responsible for loss of data, interruption of service, or security issues arising from a guest’s use of the internet.
11. Fire, Smoking, and Outdoor Safety
Guests must comply with all posted fire-safety requirements and applicable local regulations.
Smoking or vaping is not permitted inside guest accommodations.
Guests must properly dispose of cigarette butts and other smoking materials and must not leave burning materials unattended.
Open flames, grills, fire pits, or other outdoor equipment may be restricted or prohibited depending on weather, fire conditions, local regulations, or property rules.
Guests must follow all instructions provided by Art City Camp and RV Retreat regarding fire safety.
12. Weather and Natural Conditions
Art City Camp and RV Retreat is an outdoor property and may be affected by weather and natural conditions.
Guests acknowledge that Tucumcari, New Mexico may experience conditions including high temperatures, strong winds, dust, storms, lightning, cold temperatures, and other changing weather conditions.
Guests are responsible for taking reasonable precautions and following safety instructions.
When severe weather or other hazardous conditions create a safety concern, Art City Camp and RV Retreat may temporarily restrict access to certain areas or amenities.
13. Wildlife and Outdoor Hazards
Guests understand that the property is an outdoor environment where they may encounter insects, birds, wildlife, plants, uneven terrain, and other natural conditions.
Guests should not approach, feed, provoke, or attempt to handle wildlife.
Guests are responsible for exercising reasonable care while exploring or using outdoor areas.
14. Children and Minors
Children are welcome when permitted by the specific accommodation and reservation.
Parents, guardians, and supervising adults are responsible for the safety and supervision of minors at all times.
Outdoor showers, uneven terrain, vehicles, equipment, wildlife, weather conditions, and other outdoor features may present hazards to children.
Art City Camp and RV Retreat does not provide childcare or child supervision unless a separate service is expressly offered and agreed upon in writing.
15. Pets and Animals
Pets are permitted only when expressly allowed by the applicable accommodation and reservation.
Guests must comply with all pet rules communicated by Art City Camp and RV Retreat or the applicable booking platform.
Guests are responsible for their animals and for any damage, mess, injury, or disturbance caused by them.
Service animals will be accommodated as required by applicable law.
16. Quiet Enjoyment and Guest Conduct
Guests are expected to respect other guests, neighbors, and the surrounding community.
Excessive noise, disruptive behavior, threatening conduct, harassment, fighting, or behavior that creates an unreasonable disturbance is prohibited.
Guests may not use the property for activities that violate applicable laws or the policies of Airbnb, Hipcamp, or Art City Camp and RV Retreat.
17. Parties and Events
Parties, large gatherings, or events are not permitted unless specifically approved by Art City Camp and RV Retreat in advance.
Guests may not use a reservation to host an unauthorized event or gathering.
Additional terms, fees, insurance requirements, or restrictions may apply to approved events.
18. Illegal Activities
Illegal activities are strictly prohibited.
This includes activities that violate federal, state, or local laws, as well as activities that create a threat to guests, employees, neighbors, or property.
Art City Camp and RV Retreat reserves the right to take appropriate action when illegal or dangerous activity is suspected or observed, subject to applicable law and booking-platform policies.
19. RV and Camping Requirements
Guests staying in RV spaces or camping areas are responsible for complying with all posted site requirements and instructions.
Guests must use designated areas and may not occupy additional spaces without authorization.
Guests must properly secure their RV, campsite, personal belongings, and equipment.
Any hookups, utilities, dumping facilities, or other RV amenities must be used only as instructed.
Guests are responsible for ensuring that their RV and equipment are in safe operating condition.
20. Personal Property
Guests are responsible for their personal belongings, vehicles, RVs, equipment, valuables, and other property brought onto the premises.
Art City Camp and RV Retreat is not responsible for lost, stolen, damaged, or unattended personal property except where responsibility cannot lawfully be excluded.
Guests should secure valuables and personal belongings appropriately.
21. Damage, Loss, and Additional Charges
Guests may be responsible for reasonable costs resulting from damage to property caused by the guest, members of their party, or their visitors, to the extent permitted by applicable law and the policies of the applicable booking platform.
Potential charges may include, where applicable:
- Property damage
- Missing items
- Excessive cleaning
- Unauthorized smoking
- Lost keys or access devices
- Damage caused by pets
- Damage to equipment or amenities
- Costs associated with unauthorized guests or activities
When a reservation is made through Airbnb or Hipcamp, applicable claims and charges may be processed according to that platform’s procedures.
22. Cancellations and Refunds
Cancellation, refund, and reservation-change policies may vary depending on the booking platform and rate selected.
For reservations made through Airbnb or Hipcamp, the cancellation and refund policies displayed during the booking process generally govern the reservation.
Art City Camp and RV Retreat will follow the applicable booking platform’s policies when required.
23. Property Access and Maintenance
Art City Camp and RV Retreat or authorized service providers may need to enter portions of the property or accommodation for legitimate reasons, including:
- Emergency situations
- Repairs or maintenance
- Safety concerns
- Cleaning
- Property inspections
- Security concerns
- Other circumstances permitted by law or the applicable booking agreement
Whenever reasonably possible, guests will be provided appropriate notice.
24. Emergency Situations
In an emergency involving immediate danger to life, health, or property, guests should contact 911 or the appropriate emergency service first.
Guests should then notify Art City Camp and RV Retreat as soon as reasonably practical.
Guests are responsible for becoming familiar with emergency exits, property instructions, and local emergency procedures applicable to their accommodation.
25. Assumption of Outdoor Risks
Guests understand that staying at an RV, glamping, and camping property involves inherent outdoor risks.
These may include, but are not limited to:
- Uneven or slippery terrain
- Weather-related conditions
- Outdoor showers and wet surfaces
- Wildlife and insects
- Heat or cold exposure
- Fire or smoke
- Recreational and outdoor activities
- Vehicle and RV-related hazards
Guests voluntarily choose to participate in outdoor activities and use property amenities and agree to exercise reasonable care.
Nothing in these Terms is intended to waive rights or protections that cannot legally be waived under applicable law.
26. Limitation of Liability
To the fullest extent permitted by applicable law, Art City Camp and RV Retreat is not responsible for losses arising from circumstances outside our reasonable control, including weather, natural events, utility interruptions, internet outages, third-party services, or other unforeseen circumstances.
Nothing in these Terms limits liability or rights that cannot legally be limited under applicable law.
27. Third-Party Services
Art City Camp and RV Retreat may rely on third-party services, including Airbnb, Hipcamp, Starlink, payment providers, communication services, and other vendors.
Those services are subject to their own terms, conditions, and policies.
Art City Camp and RV Retreat is not responsible for interruptions or failures of third-party services outside our reasonable control.
28. Privacy
Guest information is handled in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use, protect, and share personal information, including information related to reservations, communications, security cameras, and Wi-Fi.
29. Right to Address Violations
If a guest violates these Terms, property rules, applicable law, or applicable booking-platform policies, Art City Camp and RV Retreat may take reasonable action, which may include requesting that the guest correct the violation, contacting the applicable booking platform, requiring a guest to leave the property where permitted, or pursuing recovery for damages.
Nothing in these Terms overrides the policies or procedures of Airbnb, Hipcamp, or applicable law.
30. Changes to These Terms
Art City Camp and RV Retreat may update these Terms from time to time to reflect changes to our property, services, policies, or applicable legal requirements.
The most current version will include the applicable effective date.
31. Governing Law
These Terms will be interpreted in accordance with applicable laws of the State of New Mexico, except where applicable law requires otherwise.
Any dispute will be handled in accordance with applicable law and any mandatory dispute-resolution provisions of the booking platform through which the reservation was made.
32. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Cameras are not placed inside guest accommodations or in areas where guests have a reasonable expectation of privacy, including bathrooms or private shower areas.
Security cameras may record video and, depending on the equipment, may record audio only if permitted by applicable law.
Security footage may be used for:
- Guest and visitor safety
- Property security
- Investigating accidents or incidents
- Preventing theft, vandalism, or property damage
- Protecting our guests, employees, and property
- Responding to legal or law-enforcement requests
Security footage is not used for advertising or sold to third parties.
We take reasonable steps to limit access to security footage to authorized individuals and retain footage only as reasonably necessary for security, operational, or legal purposes.
Guests may not disable, obstruct, move, cover, or tamper with security cameras or other security equipment located on the property.
5. Starlink Wi-Fi and Internet Access
Art City Camp and RV Retreat may provide guests with internet access through Starlink.
When using the property’s Wi-Fi network, certain technical information may be processed by Starlink and/or other internet service providers as part of providing internet connectivity. This may include information such as device, network, connection, and usage-related information.
Art City Camp and RV Retreat does not intentionally monitor the private contents of guests’ online communications.
However, guests should understand that no wireless or internet connection can be guaranteed to be completely private or secure.
Guests are responsible for using the Wi-Fi connection lawfully and responsibly and should avoid transmitting sensitive personal or financial information over a public or shared network.
Starlink’s collection and use of information is governed by Starlink’s own privacy practices and policies.
6. Payment Information
Reservations made through Airbnb and Hipcamp are generally processed through those platforms.
Art City Camp and RV Retreat does not intentionally request or store complete credit card or debit card numbers when payment is processed through these third-party booking platforms.
Payment information may be handled by the applicable booking or payment provider according to its own privacy and security practices.
7. Information We May Share
We may share personal information when reasonably necessary with:
- Airbnb or Hipcamp
- Payment and reservation service providers
- Property-management, cleaning, maintenance, or other service providers
- Technology or internet service providers
- Professional advisors
- Law enforcement or government authorities when legally required
- Emergency personnel when necessary to protect someone’s health or safety
We do not sell guest personal information.
8. Guest Communications
We may communicate with guests by telephone, text message, email, Airbnb, Hipcamp, or other communication methods provided by the guest or booking platform.
These communications may include reservation information, directions, check-in instructions, property rules, emergency information, maintenance notifications, or responses to guest questions.
9. Guest Reviews, Photos, and Testimonials
Guests may voluntarily provide reviews, photographs, testimonials, or other content about their experience at Art City Camp and RV Retreat.
We will not knowingly use a guest’s private personal information for advertising without appropriate permission.
If you voluntarily provide content and authorize us to use it for promotional purposes, we may use that content in accordance with the permission provided.

Security-camera footage may be retained according to our operational and security needs and applicable law.
